Small Claims Court
The Small Claims Court hears matters involving disputes for civil claims valued up to $35,000 where a party is seeking money or the return of personal property. Known as the “People’s Court”, it provides an efficient and cost-effective forum for Ontarians to bring or defend civil claims quicker and at less expense than in the Ontario Superior Court of Justice.
The Small Claims Court also hears certain applications under the Repair and Storage Liens Act.
It is important to be aware of the laws, Rules, Forms, and Court Directions that apply to your case.
The Rules of the Small Claims Court govern proceedings in this court. The main statute governing Small Claims Court cases is the Courts of Justice Act, especially the part about the Small Claims Court (sections 22 to 33.1). Depending on your case, other laws may apply as well.
This page will direct you to those resources and other guidance to help you navigate the Small Claims Court.
It is also important to use the correct forms. They are available on the Ontario Court Forms website here: Rules of the Small Claims Court Forms.
