Public Hearing Decisions
Below are the Review Council’s decisions on complaints that were referred to a public hearing and the reports of commissions of inquiry into the conduct of justices of the peace.
Justice of the Peace Gibbon applied for judicial review of the majority of the hearing panel’s disposition decision. On April October 18, 2023, the Divisional Court dismissed the application: Gibbon v. Justices of the Peace Review Council, 2023 ONSC 5797.
On November 16, 2023, an Order in Council was made removing Justice of the Peace Gibbon from office pursuant to s. 11.2 of the Justices of the Peace Act.
Justice of the Peace Ballam applied for judicial review of the hearing panel’s misconduct and disposition decisions. On April 25, 2023, the Divisional Court dismissed the application: Ballam v. Justices of the Peace Review Council, 2023 ONSC 2502.
On August 25, 2022, an Order in Council was made removing Justice of the Peace Ballam from office pursuant to s. 11.2 of the Justices of the Peace Act.
Justice of the Peace Lauzon applied for judicial review of the hearing panel’s misconduct, disposition and compensation decisions. On September 27, 2021, the Divisional Court dismissed her application for judicial review: Lauzon v. Justices of the Peace Review Council, 2021 ONSC 6174.
With leave of the Court of Appeal, Justice of the Peace Lauzon appealed the Divisional Court’s decision. On June 15, 2023, the Court of Appeal dismissed the appeal from the misconduct decision and allowed the appeal from the disposition decision: Lauzon v. Ontario (Justices of the Peace Review Council), 2023 ONCA 425. The Court of Appeal substituted the disposition imposed by the minority of the hearing panel of a reprimand and a suspension for 30 days without pay, but with benefits.
On May 9, 2024, the Supreme Court of Canada dismissed the Review Council’s application for leave to appeal.
On July 25, 2018, an Order in Council was made removing Justice of the Peace Bisson from office pursuant to s. 11.2 of the Justices of the Peace Act.
On May 2, 2018, an Order in Council was made removing Justice of the Peace Foulds from office pursuant to s. 11.2 of the Justices of the Peace Act.
Prior to the hearing, Justice of the Peace Foulds applied for judicial review of the complaints committee’s decision to order a formal hearing into the complaint. On October 3, 2017, the Divisional Court dismissed the application for judicial review: Foulds v. Justices of the Peace Review Council, 2017 ONSC 5807.
Justice of the Peace Massiah applied for judicial review of the hearing panel’s misconduct, disposition and compensation decisions. On October 4, 2016, the Divisional Court dismissed the application for review of the misconduct and disposition decisions and allowed the application for review of the compensation decision: Massiah v. Justices of the Peace Review Council, 2016 ONSC 6191. The Divisional Court sent the issue of compensation for legal costs back to the hearing panel for reconsideration.
On April 29, 2015, an Order in Council was made removing Justice of the Peace Massiah from office pursuant to s. 11.2 of the Justices of the Peace Act.
Justice of the Peace Massiah applied for judicial review of the hearing panel’s decisions. On June 4, 2014, the Divisional Court dismissed the application for judicial review: Massiah v. Justices of the Peace Review Council, 2014 ONSC 3415.
Justice of the Peace Barroilhet applied for judicial review of the hearing panel’s misconduct and disposition decisions. On June 8, 2011, the Divisional Court dismissed the application: Barriolhet v. Justices of the Peace Review Council, 2011 ONSC 3246.
On October 29, 2009, an Order in Council was made removing Justice of the Peace Barroilhet from office pursuant to s. 11.2 of the Justices of the Peace Act.
On August 21, 2008, an Order in Council was made removing Justice of the Peace Sinai from office pursuant to s. 8(1) of the Justices of the Peace Act.
Justice of the Peace Sinai applied for judicial review of the report of the commissioner and the Order in Council removing him from office. On November 17, 2010, the Divisional Court dismissed the application for judicial review: Sinai v. Ontario (Commissioner), 2010 ONSC 8025.
On November 27, 2003, an Order in Council was made removing Justice of the Peace Romain from office pursuant to s. 8(1) of the Justices of the Peace Act.
Justice of the Peace Romain applied for judicial review of the report of the commissioner and the Order in Council removing him from office. On September 6, 2005, the Divisional Court dismissed the application for judicial review: Romain v. Lieutenant Governor in Council, 2005 CanLII 31588.
Justice of the Peace Blackburn applied for judicial review of the inquiry. On April 18, 1994, the Divisional Court dismissed the application for judicial review.
On June 23, 1994, the Order in Council appointing Justice of the Peace Blackburn was revoked, following his resignation.
