For more detailed information, please see:<\/p>\n<ul>\n<li>The <a href=\"https:\/\/www.ontario.ca\/laws\/statute\/90c43\"><em>Courts of Justice Act<\/em>, R.S.O. 1990, c. C.43<\/a> (\u201c<em>CJA<\/em>\u201d)<\/li>\n<li>The <a href=\"https:\/\/www.ontario.ca\/laws\/regulation\/900194\" target=\"_blank\" rel=\"noopener\"><em>Rules of Civil Procedure, <\/em>R.R.O. 1990, Reg. 194<\/a><\/li>\n<li>The\u00a0<a href=\"https:\/\/www.ontario.ca\/laws\/regulation\/990114\" target=\"_blank\" rel=\"noopener\"><em>Family Law Rules<\/em>, O. Reg. 114\/99<\/a><\/li>\n<li>The applicable family law legislation, such as the <em>Divorce Act<\/em>, R.S.C. 1985, c. 3 (2<sup>nd<\/sup> Supp.), <a href=\"https:\/\/www.ontario.ca\/laws\/statute\/90f03\"><em>Family Law Act<\/em>, R.S.O. 1990, c. F.3<\/a> (\u201c<em>FLA<\/em>\u201d), <a href=\"https:\/\/www.ontario.ca\/laws\/statute\/90c12#BK129\"><em>Children\u2019s Law Reform Act,<\/em> R.S.O. 1990, c. C.12<\/a> (\u201c<em>CLRA<\/em>\u201d), and <a href=\"https:\/\/www.ontario.ca\/laws\/statute\/17c14\"><em>Child, Youth and Family Services Act, 2017, <\/em>S.O. 2017, c. 14<\/a>, Sched. 1 (\u201c<em>CYFSA<\/em>\u201d)<\/li>\n<\/ul>\n<h2>\nWhich court?<\/h2>\n<p>Not all family law cases can be appealed directly to the Court of Appeal for Ontario. The questions and chart below set out some <strong>general<\/strong> rules that apply in most cases. Exceptions apply.<\/p>\n<p>To begin, look at the order you want to appeal:<\/p>\n<ol>\n<li>Is the order <strong>only a monetary for an amount less than $50,000?<\/strong> If so, it does not lie to the Court of Appeal. Instead, the appeal lies to the Divisional Court: see <em>CJA<\/em>, s.19(1.2).<\/li>\n<li>Is the order <strong>interim or temporary<\/strong>? If so, unless it is an order under Sections 22, 41, 42, or 43 or the Schedule to s. 46 of the <em>CLRA<\/em> (jurisdiction\/extra-provincial matters), it does not lie to the Court of Appeal. Instead, the appeal lies to the Divisional Court with leave: see <em>CJA<\/em>, s. 19(1.2).<\/li>\n<li>Next, you need to look at <strong>which court<\/strong> made the original order and under which legislation the order was made:<\/li>\n<\/ol>\n<table border=\"1\" width=\"100%\" cellpadding=\"4\">\n<tbody>\n<tr bgcolor=\"#dacbf7\">\n<th scope=\"col\" width=\"10%\">Which court made the original order?<\/th>\n<th scope=\"col\" width=\"30%\">What legislation was the order made under?<\/th>\n<th scope=\"col\" width=\"15%\">First appeal:<br \/>\nWhich Ontario court?<\/th>\n<th scope=\"col\" width=\"35%\">Second appeal:<br \/>\nWhich Ontario court?<\/th>\n<\/tr>\n<tr bgcolor=\"#deeaf6\">\n<th rowspan=\"2\" scope=\"row\" width=\"15%\">Ontario Court of Justice<\/th>\n<td valign=\"top\" width=\"30%\">Any, unless otherwise specified in the legislation (e.g. jurisdiction\/extra-provincial orders made under Sections 22, 41,42 or 43 or the Schedule to s.46 of the\u00a0<em>CLRA<\/em>)<\/td>\n<td valign=\"top\" width=\"15%\">Superior Court of Justice<\/td>\n<td valign=\"top\" width=\"30%\">Court of Appeal<\/p>\n<p>(under certain legislation, leave is required. You will likely be contacted to schedule a conference over the telephone with a judge if you have not filed all the necessary materials for your appeal with the court within\u00a0<strong>14 days.<\/strong><\/p>\n<h2>What about fresh evidence?<\/h2>\n<p>The general rule is that you must rely on the same facts on appeal that you did at trial.\u00a0This means that the appeal court will generally only hear the evidence that was before the trial court or motion judge.<\/p>\n<p>But, if \u201cfresh\u201d evidence \u2013 evidence that existed at the time of trial but you didn\u2019t know about \u2013 or \u201cnew\u201d evidence \u2013 evidence based on new developments since the trial \u2013 concerns the child\u2019s best interests, the court may want to hear about it.\u00a0 You may try to introduce fresh or new evidence by making a motion to the panel who will hear your appeal.<\/p>\n","protected":false},"excerpt":{"rendered":"This guide is intended to provide some helpful information specific to family law appeals in the Court of Appeal for&#46;&#46;&#46;","protected":false},"author":1,"featured_media":0,"parent":2238,"menu_order":0,"comment_status":"closed","ping_status":"closed","template":"full-width-page-template.php","meta":[],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v20.10 -
