Please note a public photocopier is available for ¢50/page or the Court can make copies for $1.00/page. For the Court copies a requisition form must be completed and left with the clerk who will then contact you when the request is complete.

Viewing Book Material for Open Files:

Requests can be made in-person or by agent, phone (416-327-6245), e-mail (COA.E-file@ontario.ca) or by fax (416-327-2213).

When viewing material(s), copies can be made by:

  1. Using the public photocopier; or
  2. Requesting that the Court makes copies.

Viewing Original Papers, Charts & Exhibits:

Original papers/exhibits/charts can be viewed in-person by any member of the public by attending the Court of Appeal records office.

Reproducible original papers, exhibits and charts in criminal/civil matters can be signed out only with written consent (from the Crown in Criminal matters and by opposing parties in Civil matters), unless a judge orders otherwise.

YOU ARE REMINDED THAT ORIGINAL PAPERS, EXHIBITS AND CHARTS ARE RETURNED TO THE ORIGINATING COURT AFTER THE APPEAL OR MOTION IS HEARD AND DISPOSED OF.

Viewing Closed Files:

The Court of Appeal keeps closed files in the Records Department for a period of approximately 2 years from the date of the decision. After that time, closed files are transferred to an external storage facility.

Files from the Records Office are available the day after the request is made. These files are held for a period of 3 days, unless a special request is made.

There is a $10.00 viewing fee, which applies to any person viewing a court file on site, who is not a party to the proceeding or solicitor on record.

Files from Storage take 3-5 business days to be forwarded to the Court. The requesting party is contacted when the file is available to be viewed. These files are held for a period of 1 week, unless a special request is made.

A $75.00 fee applies to any party requesting the retrieval of a court file from the Records Retention Centre.

Please note that the court keeps files for a period of 30 years from the date of the decision. Index books are available to view in order to obtain file numbers for any files from 1965 to 1990 as there are no electronic records for these files.

All files prior to 1976 must be requisitioned from the “Archives of Ontario”.
